Description: Frederic L. Kirgis clarifies the international legal issues involved with Iran's membership in the Nuclear Non-Proliferation Treaty (NPT) to which it became a party in 1970, and its safeguards agreement with the IAEA (1974) allowing inspections. He points out the similarities to the North Korean situation, and analyzes the relevant treaty law on withdrawal or non-compliance.
"If Iran withdraws from the NPT either lawfully or unlawfully, the Security Council could determine under Chapter VII of the U.N. Charter that there is a threat to the peace and could decide on measures to maintain or restore peace and security."
